Can we check a rental applicant's criminal record?

In Quebec, the Commission d'accès à l'information takes the view that a landlord may only collect the information needed to decide whether to rent. A criminal record is generally not part of it. That is why we stick to identity and credit for tenants. Criminal record checks are meant for the staff who hold your keys. When in doubt, ask the Commission or a lawyer.

Do we need to keep a copy of the ID?

No. The result tells you the identity was confirmed. You do not have to keep the ID in your files, which keeps you from holding more personal information than you need, as Quebec's Law 25 asks.

Does the applicant have to go somewhere?

No. They get a link on their phone, show their ID, and give consent. They can do it the same evening as the visit.

What about our staff: superintendents, maintenance, contractors?

That is where a criminal record check makes sense. These people hold the keys and walk into units. Reports are issued by our police partners across Canada, and most arrive in under 15 minutes.

Is this a vulnerable sector check?

No. SafeChecker does not run the check required to work with vulnerable people, and does not issue a fingerprint certificate. A seniors' residence that needs one for its staff has to request it from its local police service.
